Bitcoin touched $80,000 on Monday and rejected within seconds. It is testing $80,000 again today. The chart looks the same. The setup is not.
Monday’s rejection happened into a market that had just run 23% in five days on a short squeeze and a Treasury bond buyback announcement. The shorts were already gone. There was nothing left to squeeze and nothing new to price in. The level held for seconds and gave back.
Today’s retest is happening into a different positioning picture. And for the first time since the rally began, there is a specific date the market is pricing.

What Lands on September 15
Two things. On the same day.
Senate Majority Leader John Thune filed cloture on the motion to proceed to the CLARITY Act. The procedural vote is scheduled for September 15, 2026. That vote determines whether the Senate can even begin debate on the bill. Sixty votes are needed. Failure to clear the September 15 procedural vote could effectively end the bill’s chances this year as other priorities steal focus heading into midterm elections.
The Federal Reserve’s next FOMC meeting runs September 15 to 16. Warsh chairs his third meeting. The market is pricing a rate cut signal. If he delivers one, long-duration assets including Bitcoin get a second macro catalyst on top of the regulatory one.
Two potential inflection points. One date. That is what Monday did not have.
Why $80,000 Is the Right Level to Watch
If Bitcoin breaks $80,000, resistance may lie close to $85,000 ahead of $90,000. If it fails to hold $80,000, a retest of the $72,000 to $75,000 range becomes the base case.
The chart on the 1H shows Bitcoin at $78,900 after touching $80,000 intraday. BTC dominance is rising at 60.12, which means Bitcoin is outperforming altcoins. The SPX and SP500 futures are both down. DXY is slightly positive. This is not a risk-on market today. Bitcoin is moving independently of equities, which is a structural signal worth noting.
The short squeeze that powered the initial move is spent. The market flushed its short positions and has no remaining sellers to absorb a reversal. What holds $80,000 now is not short covering. It is new buyers with a thesis. The thesis is September 15.
The Honest Risk
Polymarket currently assigns only a 16% chance the CLARITY Act passes during 2026. That number has not moved meaningfully despite the White House push, the Trump statements, and the SALT Conference optimism from the White House Crypto Council.
Sixteen percent is not a high-confidence bet. It means the market collectively thinks the most likely outcome is the bill failing this year. If the September 15 cloture vote fails to reach sixty votes, the legislative tailwind that Bitcoin has been pricing for four days evaporates immediately. Negotiations remain hung up over the ethics provision and other differences between Republicans and Democrats. Trump wanting the bill and seven Democratic senators agreeing to vote for it are different things.
The FOMC risk cuts both ways. A rate cut signal from Warsh at his third meeting as chair, in a 3.8% inflation environment, would be the most aggressive dovish pivot since 2020. The bond market would not welcome it quietly.
What This Week Actually Confirmed
The August 19 Treasury buyback was the real catalyst. The CLARITY Act momentum amplified a move already in progress. Bitcoin went from $62,800 to $80,000 in six days. That recovery reclaimed exactly the territory lost during the Iran escalation in June. Nothing more.
Bitcoin is still trading about 40% off its October 2025 high of $126,000. $80,000 is not a breakout. It is a return to the level that held before the war sent it to $58,000. The range is the same. The catalysts are new.
September 15 is 22 days away. Everything between now and then is positioning for that date. The $80,000 level is where that positioning is being tested right now.
Above it the path to $85,000 to $90,000 opens. Below it the market has no short sellers left to absorb a slide back toward $72,000 to $75,000.
The level is the same as Monday. The date is what changed.
